  1. you are either a Service Provider or a Service User,

1. MODIFICATIONS TO TERMS OF USE AND PRIVACY POLICY

Your continued use of the Website signifies your acceptance of any revised terms. Please review these Terms of Use regularly. If you do not agree to the updated Terms, do not use the Website.

To access certain services, you must provide necessary details like Name, Email address, Mobile number, Policy type, and Complaint type. You are responsible for all activities on your Account and must notify us of any security breaches. Unauthorized use of another’s Account is prohibited.

C. RULES FOR SERVICE USERS

1. SERVICE USERS MUST NOT:

  • Agree to terms without meeting the Service Provider's requirements;

2. SANCTIONS FOR VIOLATIONS

Violations may result in limitations on Account privileges, suspension, or decreased status on the Feedback page.

D. LIMITATION OF LIABILITY

BIMA SAHAYAK and its affiliates are not liable for any claims, damages, or losses arising from the use of the Website or Services. We do not guarantee satisfaction with the services provided. Our liability is limited to INR 2000, and claims must be made within one year of the event.

E. LIMITATION OF SERVICE PROVIDER’S LIABILITY

BIMA SAHAYAK is not responsible for delays in service beyond our control.

F. FORCE MAJEURE

We are not liable for delays caused by events beyond our control, such as natural disasters, strikes, or regulatory actions.

G. COPYRIGHT INFRINGEMENT TAKE DOWN PROCEDURE

We respect intellectual property rights. To report copyright or trademark infringement, send a Notice to contact@bimasahayak.com with the required information. Only the rights owner can report infringements.

H. MODIFICATIONS TO OR TERMINATION OF WEBSITE

2. TERMINATION BY BIMA SAHAYAK

4. EFFECT OF TERMINATION

Upon termination, you will lose access to the Website and any associated benefits. Residual data may remain in our system.

3. BIMA SAHAYAK LICENSE TO USE DATA AND MARKS

The Website contains data and trademarks owned by BIMA SAHAYAK, which may be protected under copyright, trademark, patent, trade secret, and other applicable laws. BIMA SAHAYAK retains all rights to this data and these marks. Subject to these Terms of Use, BIMA SAHAYAK grants you a limited, revocable, non-transferable, and non-sublicensable license to access and display this data (excluding any software source code) solely for personal use in connection with your interaction with the Website. The Website may also feature data from other users or licensors, which you are prohibited from copying, modifying, translating, publishing, broadcasting, transmitting, distributing, performing, displaying, or selling.

J. GOVERNING LAW AND DISPUTE RESOLUTION

This Agreement will be governed by and construed in accordance with Indian law, without regard to conflict of laws principles. In the event of a dispute arising out of or related to this Agreement, the following procedure will apply:

  1. Either Party shall provide written notice of the dispute, including details and supporting documents (“Dispute Notice”). Upon receipt, both parties will attempt to resolve the dispute in good faith.
  2. If the dispute remains unresolved within thirty (30) days of the Dispute Notice, it shall be referred to arbitration by a sole arbitrator under the Arbitration and Conciliation Act, 1996. Arbitration will occur in Delhi, with proceedings conducted in English. If the parties cannot agree on an arbitrator within thirty (30) days of a request, the Chief Justice of the High Court or a designated authority will appoint one, as per Section 11(5) of the Arbitration and Conciliation Act, 1996. Except as stated above, all matters arising under this Agreement will be subject to the exclusive jurisdiction of the courts in Delhi, and both parties irrevocably submit to this jurisdiction.

K. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless BIMA SAHAYAK, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or related to your use of the Website, violation of these Terms of Use, or any rights of third parties. This indemnity obligation will survive the termination of these Terms of Use.

L. MISCELLANEOUS

These Terms of Use constitute the entire agreement between you and BIMA SAHAYAK regarding the Website. Any failure by BIMA SAHAYAK to enforce any provision of these Terms does not constitute a waiver of that provision. If any provision is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect. These Terms of Use are personal to you and may not be assigned or transferred without our prior written consent. We may assign these Terms to any third party without restriction. No third-party beneficiaries exist under these Terms except as expressly provided herein.
